SMS Marketing and Customer Text Messaging Policy - Terms of Service

Purpose

STEC Equipment, Inc. ("STEC") uses SMS (text message) marketing to communicate with customers regarding promotions, sales events, equipment availability, service reminders, financing opportunities, and other business-related communications. This policy establishes the standards and procedures for sending SMS marketing messages while ensuring compliance with all applicable laws and Shopify Messaging requirements.

Scope

This policy applies to all STEC Equipment, Inc. employees, contractors, and authorized representatives who create, approve, or send SMS marketing communications on behalf of the company through Shopify Messaging or any other company-approved SMS platform.

Customer Consent

STEC Equipment, Inc. will only send marketing text messages to customers who have voluntarily provided their mobile phone number and have expressly opted in to receive SMS marketing communications.

All SMS consent must be obtained in accordance with applicable federal, state, and international privacy and telecommunications laws, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)
  • California Privacy Rights Act (CPRA), when applicable
  • General Data Protection Regulation (GDPR), when applicable
  • European Union ePrivacy Directive, when applicable
  • United Kingdom Privacy and Electronic Communications Regulations (PECR), when applicable

Employees may not manually add customers to SMS marketing lists without documented customer consent.

Privacy and Customer Information

Customer information collected for SMS marketing shall be treated as confidential business information.

STEC Equipment, Inc. will:

  • Collect only the information necessary for business communications.
  • Protect customer information using commercially reasonable security practices.
  • Share customer information only with approved service providers necessary to deliver SMS communications.
  • Honor customer requests to access, modify, or delete their personal information as required by law.

Terms of Communication

All SMS marketing communications must clearly communicate:

  • That message frequency may vary.
  • That message and data rates may apply.
  • Instructions for opting out (such as replying STOP).
  • Contact information for customer support.

Customers must be able to opt out of marketing communications at any time.

Approved Marketing Content

SMS marketing messages should provide value to customers and may include:

  • Equipment promotions
  • Seasonal sales and special offers
  • Service department promotions
  • Parts specials
  • Equipment demonstrations
  • Trade-in opportunities
  • Financing promotions that comply with applicable laws
  • Customer appreciation events
  • Open houses and dealership events
  • New product announcements
  • Equipment availability notifications

All messages should be professional, accurate, and representative of the STEC Equipment, Inc. brand.

Prohibited Content

The following content is strictly prohibited in SMS marketing communications:

  • False, misleading, or deceptive claims
  • Fraudulent offers or scams
  • Hate speech or discriminatory language
  • Sexually explicit or offensive material
  • Political campaigning or fundraising
  • Gambling promotions
  • Multi-level marketing or pyramid schemes
  • Third-party lead generation unrelated to STEC Equipment, Inc.
  • Malware or malicious links

Additionally, messages must not promote prohibited products or services, including:

  • Alcohol
  • Firearms, ammunition, or explosives
  • Fireworks
  • Cannabis, CBD, THC, vaping products, or tobacco
  • Prescription medications not legally sold over the counter
  • Illegal substances
  • Debt collection or debt relief services
  • Credit repair services
  • Payday loans or other high-risk lending products
  • Cryptocurrency investments or other prohibited financial services

Geographic Restrictions

Marketing text messages may only be sent to recipients in countries supported by the company's approved SMS platform. Employees are responsible for ensuring campaigns are limited to approved regions.

Employee Responsibilities

Employees responsible for SMS marketing shall:

  • Verify customer consent before sending marketing messages.
  • Review all campaign content for accuracy.
  • Ensure promotions accurately reflect current pricing and availability.
  • Obtain management approval for marketing campaigns when required.
  • Protect customer information from unauthorized disclosure.
  • Immediately report any suspected misuse of customer data or SMS communications.

Compliance

Failure to follow this policy may expose STEC Equipment, Inc. to legal liability and reputational harm.

Employees who violate this policy may be subject to disciplinary action, up to and including termination of employment.

Policy Review

This policy shall be reviewed periodically and updated as necessary to comply with changes in applicable laws, regulations, Shopify Messaging requirements, and company business practices.
